Delhi court stays search warrant issued against Mehmood Pracha

Delhi court has stayed till March 12th the search warrant procured by the Delhi police against advocate Mehmood Pracha, after he moved to the court against the second raid conducted at his office on Tuesday.

Mahmood Pracha, representing some accused of Delhi riots, has been alleged with the usage of forged documents in judicial records in a Northeast Delhi riots case.

The same intelligence team along with technical experts had earlier conducted a 15-hour-long raid at his office in December 2020. The raids had been widely condemned by members of the legal fraternity, who called it a breach of judicial autonomy.

Mentioning this, Pracha moved an application before Chief Metropolitan Magistrate, saying that the police have already collected documents and accessed all computers in his office during the raids conducted in December 2020.

In his plea, he claimed that the case against him is “a part of conspiracy involving senior politicians, bureaucrats and even judicial officers."

Pracha in the application adds that he volunteers to furnish any specific documents sought by the investigation agency and also re-furnish whatever was taken during the previous exercise. 

Chief Metropolitan Magistrate at the Patiala House Court Pankaj Sharma will pronounce orders in Pracha’s application on March 12.

Mehmood Pracha is currently pleading several cases related to the Northeast Delhi riots, in which 54 died and around 400 injured. He is representing several student activists who have been unfairly charged under UAPA, including Gulshifa Fatima.
